§ 1 Scope and General Provisions

1.1 The mobile application "Jourma" (hereinafter referred to as the "App") is operated by Jourma GmbH, Taunustor 1, 60310 Frankfurt am Main (hereinafter referred to as "Jourma"). Full details of the provider are set out in the Legal Notice (Impressum) (§ 21).

1.2 These Terms and Conditions (hereinafter referred to as "T&C" or "Terms of Use") govern the relationship between you as a user and Jourma with respect to the use of the App. They apply to all users of the App. By registering for and using the App, you declare your agreement to these terms. It is recommended that you save or print a copy of these terms for your records.

1.3 These T&C shall enter into force on April 5, 2026 and shall fully replace the previous Terms of Use in Version 2.0.

1.4 All features and services available in the App are subject to these provisions. Deviations from these terms require the express written consent of Jourma.

1.5 These T&C may be translated into multiple languages. In the event of any discrepancies or ambiguities between different language versions, the German version shall be the sole authoritative and legally binding version.


§ 2 Description of Services

2.1 General

The App is an all-in-one travel app that combines a variety of services, including communication, information and entertainment services, on a single platform. Jourma is not a travel agency/tour operator and does not sell or broker travel services; Jourma organises booking information provided by the user and redirects to third-party providers. Jourma provides its own services directly to the user and additionally enables access to third-party services through the platform (see § 16).

2.2 Jourma's Own Services

Jourma provides users with its own services at two service levels: a free plan ("Free Plan") and a paid subscription plan ("Pro Plan"). The subscription terms for the Pro Plan are set out in §§ 5–11. The Free Plan includes basic travel planning and management features. The Pro Plan includes all features of the Free Plan as well as additional premium features, including AI-powered processing and WhatsApp integration (see § 12). A current and detailed description of the features included in the respective plans is available in the App.

2.3 Availability

Jourma endeavours to ensure continuous and uninterrupted use of the App. However, uninterrupted availability cannot be guaranteed. Technical issues, maintenance work or force majeure may cause temporary disruptions. Planned maintenance will, where possible, be announced in advance. There is no entitlement to permanent availability of the App or individual services. Claims for compensation for temporary disruptions are excluded, provided Jourma is not at fault. Users should regularly install updates to benefit from improvements and bug fixes. Jourma reserves the right to temporarily or permanently discontinue certain features or services for technical, legal or economic reasons. For paid services (Pro Plan), the provisions of § 5.3 on reasonableness and the user's right of termination in the event of material restrictions shall apply.

2.4 Advertising

Jourma may enter into advertising partnerships with shops, brands, companies and partners. Such advertising may be displayed in the App in various forms.

2.5 Prices and Currency

The prices for Jourma's own services (in particular the Pro Plan) are displayed in the App and in the App Stores in the local currency of the user's App Store region and are inclusive of the applicable statutory value added tax or comparable consumption taxes. The binding prices are determined by the display in the App Store at the time of purchase (see § 5.4).

Where prices of third-party products or services are displayed in the App, these are for orientation purposes only. Such prices may be quoted in various currencies and may change at any time without prior notice. Jourma assumes no liability for the timeliness, accuracy or completeness of displayed third-party prices. They merely constitute a non-binding option to view prices at different locations or from different external providers, in order for the user to independently compare such prices and to derive their own purchasing decision.

2.6 Exchange Rates

The exchange rates displayed and the data used in the price converter serve exclusively as reference values and are generally updated daily, unless otherwise indicated in the App. As exchange rates may fluctuate during the day, product prices displayed in the App may also vary. Jourma assumes no liability for fluctuations in exchange rates or possible deviations in the displayed rates.

2.7 Location and Place Information

The depiction of city boundaries when selecting a location within the App serves solely as a guide and is indicative. The displayed boundaries may differ from the actual city boundaries and have no legal force. Within the App, queries and searches are conducted within the recorded city boundaries of a city; however, the delimitation of city boundaries may vary.

The places displayed in the App (e.g., shops, restaurants, cafés) are not affiliated with Jourma. Information such as opening status, operating hours, business existence or location details may vary and are subject to change; Jourma assumes no warranty or liability in this regard.

The product names and/or descriptions displayed in the App (e.g., coffee specialities offered in a café) have been standardised and may differ from the products actually offered at the respective establishments.

2.8 Price Statistics

Price statistics and historical data displayed in the App are to be understood as reference values. They serve solely for informational purposes and cannot be relied upon as a binding basis for business or financial decisions.

2.9 Recommendations and Blog Posts

The "Recommendations" and "Blog Posts" provided in the App serve exclusively for general informational purposes. They may contain inaccuracies or errors and are not to be understood as binding or guaranteed accurate information.

2.10 Restaurant Reservations

Jourma offers the feature to make restaurant reservations through the App. By using the reservation services, the user agrees to receive reservation and waitlist confirmations, updates, changes and/or cancellations via email or other electronic messages (e.g., via the App). If a reservation cannot be honoured, it must be cancelled no later than 30 minutes before the reserved time via the App or by telephone with the restaurant. The respective terms of the restaurant shall apply. Jourma assumes no liability for services rendered by the restaurants or for charges to the specified payment method resulting from a failure to cancel or a late cancellation in accordance with the restaurant's rules.

2.11 User Reviews

The comments, user reviews and ratings published in the App reflect solely the opinion of the respective user. Jourma assumes no responsibility or liability in this regard, provided that all related obligations on the part of Jourma have been fulfilled.

2.12 AI-Powered Features

Certain features of the App, in particular in the Pro Plan and the WhatsApp integration (§ 12), make use of AI systems (artificial intelligence), including large language models. AI-generated content and responses are created with the utmost care, but may contain inaccuracies. Users are advised to always verify critical travel information against official sources of the respective airline or provider. Jourma assumes no warranty for the accuracy, completeness or timeliness of AI-generated content.

2.13 Invitation to Treat (Invitatio ad offerendum)

The presentation of features and services in the App does not constitute a binding offer within the meaning of § 145 BGB, but rather an invitation to treat (invitatio ad offerendum). A binding contract for paid services (Pro Plan) is only concluded in accordance with §§ 5–11.


§ 3 Registration and Account

3.1 Use of the App requires registration. This involves providing personal data, choosing a username and setting a secure password. Registration itself is free of charge; however, certain services may be subject to a fee (see §§ 5–11). Users have no entitlement to registration. Jourma reserves the right to refuse new registrations at its own discretion.

3.2 Users must provide accurate and complete information during registration. Inaccurate or incomplete information may result in the suspension or deletion of the account. Jourma is entitled to verify the accuracy of the information provided and to request supporting evidence where necessary. Changes to personal data must be updated without undue delay.

3.3 After registration, users receive an email containing a verification code. The account is only activated after entering this code in the app, in order to prevent misuse. If verification is not completed within the designated period, Jourma may revoke the registration.

3.4 Only one user account per user is permitted. Multiple registrations are not allowed and may result in the suspension or deletion of all affected accounts. Sharing the user account with third parties is likewise prohibited. In the event of suspected unauthorised use, Jourma must be notified immediately.

3.5 Use of the App is restricted to persons who have reached the age of 18.


§ 4 Usage Rights and Changes to T&C

4.1 Usage Rights

The App is made available by downloading it onto a suitable device. Use requires an internet-enabled smartphone and a stable internet connection. The App can be installed on iOS and Android devices; it is the user's responsibility to ensure that their device meets the technical requirements. Jourma cannot guarantee unrestricted functionality on all devices and operating system versions. Any costs incurred by the user for the technical prerequisites required for the installation and use of the App shall be borne by the user.

4.2 User Obligations

Users agree to use the App in compliance with applicable laws and these Terms of Use. Abusive use, in particular circumventing security measures or distributing harmful software, is strictly prohibited. Jourma takes appropriate measures to ensure the security of the App and the integrity of user data. Violations may result in legal consequences.

4.3 Changes to these T&C

Jourma is entitled to amend these Terms of Use. Such amendments may be necessary to comply with legal requirements, to introduce new features or to optimise existing services.

Amendments to these T&C shall be communicated to users as follows:

(a) Users shall be informed of the planned changes at least thirty (30) days before the effective date of the amendment by email to the most recently registered email address and by a notification within the App.

(b) The notification shall contain a summary of the material changes, the effective date and a link to the full text of the updated T&C on the Jourma website or in the App. The full text of the amended T&C is available at all times via the App and the website.

(c) Amended T&C require the express consent of the user. Consent shall be obtained the next time the App is opened after the amendment takes effect. Without the user's express consent, the amended provisions shall not become part of the contractual relationship.

(d) If the user does not consent to the amended T&C, the user has the right to terminate the contractual relationship with Jourma. Jourma shall inform the user of this right in the amendment notification.

(e) The notice period pursuant to subsection (a) is not required where the amendments are necessary to implement new statutory requirements, a court judgment or administrative decision directed at Jourma, or where the amendments are exclusively beneficial to or legally neutral for the user.


§ 5 Subscription Plans and Pricing

5.1 Service Levels

Jourma offers two service levels for the use of the App: a free tier ("Free Plan") and a paid subscription tier ("Pro Plan"). Registration and use of the Free Plan is free of charge.

5.2 Free Plan

The Free Plan includes access to the following features, subject to the limitations set out herein:

(a) Travel planning and itinerary management; (b) Expense tracking in multiple currencies; (c) Basic collaboration (view-only access for shared trips); (d) Flight search and flight information; (e) Place discovery; (f) Inbox notifications; (g) Up to three (3) file attachments per trip.

The scope of features available under the Free Plan may be adjusted by Jourma from time to time. Jourma shall inform users of material changes.

5.3 Pro Plan

The Pro Plan includes all features of the Free Plan and additionally grants access to the following premium features:

(a) Offline mode for trips; (b) Unlimited attachments and insurance documents; (c) Real-time flight push notifications; (d) Email forwarding and automatic booking extraction; (e) Document upload with automatic data extraction; (f) AI-powered travel itinerary creation; (g) Collaborative trip editing (editing and commenting permissions); (h) Enhanced privacy controls for sharing; (i) WhatsApp travel management — AI travel assistant via WhatsApp (see § 12).

Jourma reserves the right to modify, add or remove features of the Pro Plan, provided that such changes are reasonable for the user taking into account the interests of Jourma. Changes shall not materially reduce the overall value of the Pro Plan. Users shall be informed of material changes at least thirty (30) days in advance. In the event of material restrictions to the scope of features, the user has the right to terminate the subscription as of the date on which the change takes effect.

5.4 Pricing and Currency

The binding prices for the Pro Plan are displayed at the time of purchase in the Apple App Store or Google Play Store (together the "App Stores"). Prices may be displayed in the local currency of the user's country and App Store region. The price shown in the App Store at the time of purchase constitutes the binding final price. All displayed prices are inclusive of the applicable statutory value added tax (VAT) or comparable consumption taxes, unless otherwise indicated.

The Pro Plan is available in the following billing periods:

(a) Monthly subscription (billed monthly); (b) Annual subscription (billed annually).

A current and detailed description of the features included in the respective plans as well as the applicable prices are available in the App Stores.

5.5 Subscription Management

Jourma uses the services of a specialised subscription management platform (currently Adapty, Inc., hereinafter "Adapty") for the management of subscription plans, pricing and related configurations. The actual invoicing and payment processing is carried out exclusively through the App Stores. Further information on data processing in connection with subscription management can be found in § 19.


§ 6 Conclusion of Contract, Automatic Renewal and Billing

6.1 Conclusion of Contract. By completing the in-app purchase process through the respective App Store, the user enters into a subscription agreement for the Pro Plan. The subscription agreement is concluded between the user and Jourma; however, payment processing is carried out by the respective App Store operator (Apple Inc. or Google LLC) and is subject to its terms.

6.2 Billing Periods. The billing period (monthly or annual subscription) is selected by the user at the time of purchase.

6.3 Automatic Renewal. All Pro Plan subscriptions are automatically renewed at the end of the respective billing period for a further period of the same duration, unless the user cancels the subscription before the renewal date in accordance with § 8. The renewal fee is charged to the user's App Store account within twenty-four (24) hours before the expiry of the current billing period at the then-current subscription price.

6.4 Payment Method. All payments are processed through the payment method registered in the user's App Store account. Jourma does not collect, process or store any payment card data or other payment instrument data directly. The user is responsible for ensuring that the payment method registered with the App Store is valid and sufficiently funded.

6.5 Failed Payments. If a renewal payment fails, the App Store may attempt to re-charge the payment method in accordance with its own retry policies. If payment cannot be collected, the subscription may be suspended or terminated by the App Store, and the user's access to Pro Plan features will be reverted to the Free Plan.


§ 7 Free Trial

7.1 Jourma may offer a free trial period for the Pro Plan ("Free Trial"). The duration of the Free Trial is seven (7) days, unless otherwise indicated at the time of the offer. Availability and conditions shall be communicated to the user within the App or the App Store.

7.2 During the Free Trial, the user receives free access to the Pro Plan features. Each user is entitled to only one Free Trial. Jourma reserves the right to determine eligibility for a Free Trial at its own discretion.

7.3 Conversion to a Paid Subscription. Unless the user cancels the subscription before the expiry of the Free Trial period, the subscription shall be automatically converted into a paid Pro Plan subscription. The user's App Store account shall be charged the subscription fee for the selected billing period upon conversion.

7.4 The user may cancel the Free Trial at any time before its expiry through the subscription management settings of the respective App Store (see § 8). If the Free Trial is cancelled before expiry, the user retains access to the Pro Plan features until the end of the Free Trial period, after which the account will be reverted to the Free Plan.

7.5 Jourma reserves the right to modify, suspend or discontinue Free Trial offers at any time without prior notice. Changes shall not affect Free Trials already in progress.


§ 8 Cancellation of Subscription

8.1 Cancellation via the App Stores. Pro Plan subscriptions may only be cancelled through the subscription management settings of the respective App Store through which the subscription was concluded:

(a) Apple App Store (iOS): Users may manage and cancel subscriptions through their Apple ID account settings under "Subscriptions" or as otherwise provided by Apple. (b) Google Play Store (Android): Users may manage and cancel subscriptions through the Google Play Store app under "Subscriptions" or as otherwise provided by Google.

8.2 Cancellation of Subscriptions. If the user has purchased a paid subscription through the Apple App Store or Google Play Store, management and cancellation of the subscription is carried out exclusively through the respective App Store operator and its account settings (e.g. Apple ID/Google Account). Jourma does not have access to the cancellation functionality of the App Stores and cannot cancel subscriptions on behalf of the user. Jourma provides the user with information and links within the App on how to cancel through the respective App Store operator.

8.3 Effect of Cancellation. After cancellation, the subscription remains active until the end of the current paid billing period. The user retains access to Pro Plan features for the remaining duration of that period. At the end of the billing period, the account will be reverted to the Free Plan. Pro rata refunds for unused portions of a billing period shall not be granted, unless required by applicable law or the provisions of § 9.

8.4 Users are advised to cancel their subscription in good time before the next renewal date. Reference is made to the cancellation deadlines of the respective App Store, as the renewal fee may be charged up to twenty-four (24) hours before the expiry of the current billing period.


§ 9 Right of Withdrawal (Widerrufsrecht)

9.1 Withdrawal Notice (Widerrufsbelehrung)

Consumers have a statutory right of withdrawal for contracts for the provision of digital content or digital services.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us (Jourma GmbH, e-mail: support@jourma.de) by means of a clear statement (e.g. by e-mail) of your decision to withdraw from this contract.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of your right of withdrawal before the withdrawal period has expired.

9.2 Withdrawal and Refund via the App Stores (Widerruf und Erstattung über die App Stores)

All paid services (subscriptions, in-app purchases) are processed exclusively through the Apple App Store or Google Play Store. Jourma does not accept payments directly from the user at any time. Reversal (withdrawal/refund) is therefore technically only possible through the respective App Store operator and is subject to its policies. The App Store operator decides on the refund and executes it via the payment method stored by the user. Jourma can neither promise nor execute refunds itself, but will assist the user upon request with information on how to apply to the respective App Store operator (e.g. references to the relevant help pages).

9.3 Expiry of the Right of Withdrawal for Digital Content / Digital Services (Erlöschen des Widerrufsrechts)

The right of withdrawal expires for a contract for the supply of digital content which is not supplied on a tangible medium, or for digital services, if Jourma has begun the performance of the contract after the user has
(a) expressly consented to Jourma beginning the performance of the contract before the expiry of the withdrawal period, and
(b) confirmed their awareness that they lose their right of withdrawal by giving such consent once performance of the contract has begun.

The consent and confirmation of awareness is provided within the order process of the respective App Store operator or through the mechanism provided by the App Store operator. Jourma has no influence on the design of the order process of the App Store operator.


§ 10 Refund Policy (Erstattungsrichtlinie)

10.1 All paid services (e.g. subscriptions or in-app purchases) are purchased and billed exclusively through the Apple App Store or Google Play Store. Jourma does not accept payments directly from the user.

10.2 Refunds can only be requested through the respective App Store operator. The decision on a refund and the payment are made by the App Store operator in accordance with its terms. Jourma can neither promise nor execute a refund itself.

10.3 Jourma will assist the user upon request with general information and guidance on how to apply to the respective App Store operator (e.g. references to the relevant help pages).


§ 11 Price Changes

11.1 Jourma reserves the right to change subscription prices for the Pro Plan at any time. Price changes shall not affect the current billing period of existing subscriptions.

11.2 For existing subscribers, a price increase shall only take effect at the beginning of the next billing period following the change. Users shall be informed of price changes in advance through the App Store or by a notification within the App, in accordance with the requirements of the respective App Store and applicable law.

11.3 If a user does not agree to a price increase, the user may cancel the subscription before the new price takes effect in accordance with § 8.

11.4 Price reductions or special offers may be granted at the discretion of Jourma and do not entitle existing subscribers to retroactive adjustments for past billing periods.


§ 12 WhatsApp Integration Service

12.1 Service Description

The WhatsApp integration service ("WhatsApp Travel Management") is an optional premium feature available exclusively as part of the Pro Plan. The service enables users to interact with their travel data via the WhatsApp messaging platform. Jourma provides this service using the WhatsApp Business API of Meta Platforms, Inc.

The features include in particular: travel queries, document retrieval, booking management, flight status information, weather and event information, and proactive travel notifications.

12.2 Access Requirements, Account Linking and Legal Basis

The following requirements apply to the use of the WhatsApp integration service:

(a) An active Pro Plan subscription; (b) A valid WhatsApp account; (c) Completion of the account linking process (OTP verification), through which the user voluntarily links their WhatsApp telephone number to their Jourma account.

The processing of Personal Data in connection with the WhatsApp integration service is based on the following legal bases:

(i) Art. 6(1)(b) GDPR (Performance of Contract) — for the processing of messages, travel data and account information necessary for the provision of the WhatsApp integration service included in the Pro Plan; (ii) Art. 6(1)(a) GDPR (Consent) — for the sending of proactive notifications (e.g., flight status changes, travel reminders), which the user may revoke at any time in accordance with § 12.9.

Jourma reserves the right to suspend WhatsApp access in cases of misuse, violations of the Terms of Use or the Meta platform policies.

12.3 Permitted Use

Use of the WhatsApp integration service is permitted exclusively for travel management purposes. In particular, the following are prohibited:

(a) using the WhatsApp channel to circumvent subscription limitations of the App; (b) sending automated or bot-generated messages to the Jourma WhatsApp number; (c) sending illegal, harmful or offensive content; (d) attempting to extract data of other users; (e) using the service for purposes unrelated to travel management.

12.4 Service Limitations and Disclaimers

(a) AI Accuracy: Responses provided through the WhatsApp channel are generated by AI systems (including large language models) and may contain inaccuracies. Users are advised to always verify critical travel information against official sources of the respective airline or provider.

(b) Weather and Event Data: These are provided by third-party services and may be inaccurate.

(c) Flight Status Information: This is sourced from external data providers. Jourma is not responsible for delays in updates or inaccuracies.

(d) Message Delivery: The delivery of WhatsApp messages depends on Meta's infrastructure and the user's internet connection. Jourma does not guarantee the delivery of proactive notifications.

(e) Availability: The WhatsApp service may be unavailable during maintenance, Meta platform outages or API changes.

(f) Not a Travel Agency: Jourma is a travel management tool and not a travel agency. No travel services are arranged or provided through the WhatsApp service.

12.5 Third-Party Services in the WhatsApp Integration

The WhatsApp integration service makes use of services from various third-party providers, in particular Meta Platforms (WhatsApp Business API), cloud infrastructure providers for AI processing, and data providers for flight status, weather and event information. By using the WhatsApp integration service, the user acknowledges that data may be processed by these third-party providers. Further information can be found in the Jourma Privacy Policy and in § 19.

12.6 AI Transparency and Provider Selection

The user is informed that messages in the WhatsApp channel are processed and responded to by AI systems. The user may select the AI provider used to process their queries within the WhatsApp channel itself. The available AI providers are listed in § 19.3. The first message from Jourma in the WhatsApp channel includes a corresponding notice regarding AI-powered processing and the currently selected AI provider. No fully automated decisions with legal or similarly significant effects for the user are made.

12.7 Intellectual Property

AI-generated responses are provided to the user without any separate intellectual property rights. Content submitted by the user remains the property of the user. Jourma reserves the right to use anonymised and aggregated interaction data to improve the service.

12.8 Termination and Data Deletion

(a) The user may terminate WhatsApp access at any time by unlinking the account in the App settings.

(b) Upon unlinking: Proactive messages shall cease immediately; the telephone number mapping shall be deleted without undue delay; the conversation history shall be retained for a period of thirty (30) days after unlinking and subsequently deleted, unless statutory retention obligations (in particular pursuant to §§ 147, 257 Handelsgesetzbuch (HGB) or § 147 Abgabenordnung (AO)) prevent earlier deletion.

(c) Upon account deletion: All WhatsApp-related data shall be deleted as part of the standard account deletion process.

12.9 Proactive Notifications

The user may separately control proactive notifications (e.g., flight status notifications, gate/terminal changes, travel reminders) in the App settings. The user may deactivate proactive notifications at any time, including by typing "STOP" in the WhatsApp chat.


§ 13 User Responsibility for Account Security

13.1 Users are responsible for the security of their login credentials and must not share them with third parties. It is recommended to choose a secure password and to update it regularly. In the event of suspected unauthorised access, Jourma must be notified immediately. Users may change their password via the App or contact support to lock the account. Jourma shall take all reasonable measures to prevent misuse.

13.2 Jourma shall not be liable for damages caused by the improper handling of login credentials, provided the user is at fault. Any action carried out through the account shall be attributed to the user, unless unauthorised access is proven.


§ 14 Intellectual Property Rights and Copyright

14.1 All content of the App, including software, designs, trademarks and logos, is subject to the intellectual property rights of Jourma or their respective rights holders.

14.2 The use of Jourma's trademarks, logos or other protected marks without express consent is prohibited. This applies in particular to use in domain names, social media profiles or other online presences. Jourma shall rigorously enforce violations of intellectual property rights.

14.3 Users are obliged to respect the copyrights of third parties. No content may be uploaded or distributed that infringes these rights. Jourma reserves the right to remove such content and to suspend affected users.


§ 15 Restrictions and Prohibited Uses

15.1 The App must not be used for unlawful purposes. In particular, it is prohibited to use the App to distribute illegal content, for fraudulent activities or to infringe the rights of third parties. Jourma reserves the right to rigorously pursue violations and to initiate necessary legal proceedings.

15.2 Copying, modifying or distributing content from the App without express consent is prohibited. This also applies to the circumvention of technical protection measures or any use of the App that violates these Terms of Use. It is prohibited to upload or distribute content containing malware, viruses or other harmful components. Jourma reserves the right to immediately remove such content and to suspend the affected user.

15.3 The use of automated systems or software to interact with the App, in particular bots, scrapers or crawlers, is prohibited. Jourma employs technical measures to prevent such misuse. Violations may result in account suspension and legal consequences.

15.4 Users agree to use the App in a respectful and responsible manner. Harassment, insults or discriminatory content are not permitted. Jourma promotes a positive and respectful community and will sanction violations accordingly.


§ 16 Third-Party Services

16.1 Access to Third-Party Services

Jourma displays references to third-party services within the App (e.g., restaurant reservations, ticket bookings, external information services). When using such offerings, the user is redirected directly to the website or application of the respective third-party provider. Jourma neither provides the technical infrastructure for these services nor acts as a travel intermediary or intermediary within the meaning of travel law.

When using such third-party services, no contractual relationship is established between the user and Jourma. All contractual arrangements, including pricing, payment processing and service provision, are entered into exclusively between the user and the respective third-party provider. Jourma has no control over these services and assumes no responsibility for their content, quality or availability. The user is subject to the terms and conditions and privacy policies of the respective third-party provider when using such offerings.

16.2 Distinction from Jourma's Own Services

The provisions of this § 16 apply exclusively to third-party services referenced within the App. Jourma's own services, in particular the Pro Plan (§§ 5–11) and the WhatsApp integration service (§ 12), are provided directly by Jourma. In this respect, Jourma is the direct contractual partner of the user.

16.3 Google Maps

The App includes features and content from Google Maps, a service of Google Cloud EMEA Limited, 70 Sir John Rogerson's Quay, Dublin 2, Ireland. The use of Google Maps features and content is subject to the then-current versions of the Google Maps Additional Terms of Use (see https://maps.google.com/help/terms_maps/) and the Google Privacy Policy (see https://policies.google.com/privacy).


§ 17 Termination and Suspension

17.1 Termination by the User

The usage agreement is concluded for an indefinite period. The user may terminate the contractual relationship at any time without giving reasons. Termination may be effected via the account settings in the App or by email to info@jourma.de. Upon termination, Jourma shall notify the user of the termination of the contractual relationship and block access to the App. Users should back up all relevant data before termination, as access to stored content or personal data will no longer be available after account deactivation.

17.2 Termination and Suspension by Jourma

Jourma reserves the right to suspend or terminate accounts in the event of violations of the Terms of Use. This applies in particular in cases of illegal activities, misuse of the App or violations of applicable laws. Jourma shall inform the user of the suspension or termination. In severe cases, suspension may occur without prior notice.

The right to extraordinary termination for good cause remains unaffected.

17.3 Inactivity

Jourma may also suspend or delete user accounts in the event of prolonged inactivity. Inactivity shall be deemed to exist where a user has not utilised any services of the App for a period of 12 months. Jourma shall inform the user in good time before deleting the account. The user has the option of keeping the account active by logging in again.

17.4 Effects on Subscriptions

Voluntary Account Deletion. If a user deletes their Jourma account (via the App settings or by request to Jourma), access to Pro Plan features shall cease immediately upon account deletion. Account deletion does not automatically cancel an active App Store subscription. The user remains responsible for cancelling the subscription in accordance with § 8 through the respective App Store to avoid further charges. Jourma shall make reasonable efforts to inform the user at the time of account deletion that an active App Store subscription must be cancelled separately through the App Store.

Account Termination by Jourma. If Jourma terminates or suspends a user's account for good cause (e.g., due to a material breach of these T&C), access to Pro Plan features shall be revoked immediately. In the event of termination for a cause attributable to the user, there shall be no entitlement to a refund for the remaining subscription period. The user's obligation to pay outstanding subscription fees shall remain unaffected.

Reactivation. If a user who has deleted their account creates a new account, the previous subscription status shall not be reinstated. The user must subscribe to the Pro Plan again to regain access to Pro Plan features.

17.5 Consequences of Violations

Jourma shall rigorously pursue violations of the Terms of Use and reserves the right to initiate civil and criminal proceedings. Users who violate the provisions must expect legal consequences. Users who cause damage through their conduct are obliged to provide compensation. In the event of serious or repeated violations of the Terms of Use, Jourma may restrict or revoke the usage rights to content and services granted through the App, to the extent proportionate to the violation.

17.6 Existing Contractual Relationships with Third Parties

The termination of the contractual relationship between the user and Jourma shall have no effect on existing contractual relationships with third-party providers whose services were accessed through the App. If the user has used paid or free third-party services, these shall continue to exist independently of the termination of the Jourma account. The user remains obliged to settle any amounts due to the third-party provider directly, provided that the contractual relationship with such provider has not been separately terminated.

17.7 Data Retention

Following account termination, Jourma shall process Personal Data in connection with the account and any subscriptions in accordance with the Privacy Policy and applicable retention obligations under the GDPR and other applicable laws. Certain data (e.g., transaction records) may be stored for the statutory retention periods.


§ 18 Liability

18.1 Jourma assumes no warranty for the continuous availability and error-free operation of the services offered, including the AI-powered features and the WhatsApp integration service. Temporary outages or disruptions may occur, in particular due to technical failures, maintenance work or external circumstances beyond the control of Jourma. Jourma shall, however, endeavour to resolve such disruptions as quickly as possible and to restore normal operations.

18.2 The liability of Jourma and its vicarious agents and persons employed in the performance of its obligations for damages suffered by users, regardless of the legal basis, is excluded. This shall not apply insofar as the damage was caused by intent or gross negligence, or relates to damages arising from injury to life, body or health, or from the breach of material contractual obligations (cardinal obligations). However, liability for the breach of material contractual obligations is limited to the typical and foreseeable damage. Material contractual obligations are those obligations the fulfilment of which is essential for the proper performance of this contract and on the observance of which users regularly rely and are entitled to rely. Liability under the Product Liability Act (Produkthaftungsgesetz) and other mandatory statutory provisions remains unaffected.

18.3 The content provided in the App, including AI-generated content, is created and maintained with the utmost care; however, Jourma does not guarantee its accuracy, completeness or timeliness. It is possible that content may be erroneous or incomplete. Users should therefore always consult additional sources and conduct their own research before making decisions based on the information provided. Jourma shall not be liable for any resulting consequences.

18.4 The liability limitations of this § 18 shall also apply to the services provided through the Pro Plan (§§ 5–11) and the WhatsApp integration service (§ 12).


§ 19 Data Processing for Subscriptions and WhatsApp Integration

19.1 Adapty as Data Processor

In connection with the management and provision of subscriptions, Jourma uses the services of Adapty, Inc. ("Adapty") as a subscription management platform. Adapty acts as a Data Processor on behalf of Jourma within the meaning of Art. 28 of the General Data Protection Regulation (EU) 2016/679 ("GDPR").

The following categories of Personal Data may be processed by Adapty in connection with subscription management:

(a) Anonymised or pseudonymised user identifiers; (b) Subscription status and history (e.g., plan type, start date, renewal date, cancellation date); (c) Transaction identifiers and purchase receipts (as provided by the App Stores); (d) Device and platform information relevant to the subscription (e.g., operating system, App Store region); (e) Free Trial eligibility and usage data.

A Data Processing Agreement pursuant to Art. 28 GDPR exists between Jourma and Adapty. Adapty processes Personal Data exclusively on the documented instructions of Jourma and solely for the purpose of subscription management, analysis and optimisation.

19.2 Meta Platforms as Independent Data Controller

In connection with the WhatsApp integration service (§ 12), the WhatsApp Business API of Meta Platforms, Inc. is used. Meta Platforms Ireland Ltd. acts as an independent Data Controller within the meaning of the GDPR with respect to the data processed within the WhatsApp platform itself. Jourma is the Data Controller for the data processing within the WhatsApp integration within Jourma's own systems.

19.3 AI Service Providers as Data Processors

Jourma uses AI service providers for AI-powered features of the App (in particular the AI-powered travel itinerary creation pursuant to § 5.3 and the WhatsApp integration service pursuant to § 12). Within the WhatsApp integration service, the user may select the AI provider themselves. The following AI service providers may act as Data Processors on behalf of Jourma within the meaning of Art. 28 GDPR:

(a) OpenAI, Inc. (San Francisco, USA) — operator of GPT models; (b) Anthropic, Inc. (San Francisco, USA) — operator of Claude models; (c) Google LLC (Mountain View, USA) — operator of Gemini models.

A Data Processing Agreement pursuant to Art. 28 GDPR exists with each of the aforementioned providers. Processing is limited to the processing of inputs submitted by the user via the App or the WhatsApp channel for the purpose of generating a response. Storage of Personal Data by the AI service providers beyond the immediate query processing shall not take place, unless required for the fulfilment of statutory obligations.

Where data is transferred to the aforementioned providers in the USA, such transfer takes place on the basis of the adequacy decision of the European Commission pursuant to Art. 45 GDPR (EU-U.S. Data Privacy Framework) or on the basis of Standard Contractual Clauses pursuant to Art. 46(2)(c) GDPR.

The user shall be informed of the respective service provider upon selecting the AI provider in the WhatsApp channel. For AI-powered features within the App, the AI provider used is specified in the App Privacy Policy.

19.4 App Store Operators

The App Store operators (Apple Inc. and Google LLC) process payment and subscription data independently in accordance with their own privacy policies. Jourma has no control over the independent data processing by the App Store operators and assumes no responsibility therefor.

19.5 Further Information

Further information on the processing of Personal Data, including the legal bases for processing, the rights of data subjects and information on further Data Processors, is contained in the Jourma Privacy Policy, which is available in the App and on the Jourma website.


§ 20 Applicable Law and Jurisdiction

20.1 The contract shall be governed by the laws of the Federal Republic of Germany. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.

20.2 The place of performance and Jurisdiction shall be Frankfurt am Main, to the extent permitted by law.

20.3 If the user has no general place of Jurisdiction in the Federal Republic of Germany, Frankfurt am Main, Germany, shall be a non-exclusive place of Jurisdiction.

20.4 Consumer Protection. For consumers habitually resident in the European Union, the mandatory provisions of the consumer protection law of the state of the consumer's habitual residence shall additionally apply, insofar as they provide a higher level of protection. These T&C shall not affect the inalienable rights of the consumer under the law of their habitual residence.

§ 22 Final Provisions

22.1 Severability Clause. Should individual provisions of these Terms of Use be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. In place of the invalid provisions, the relevant statutory provisions shall apply.

22.2 No Oral Side Agreements. No side agreements to this contract exist. Amendments and supplements require Text Form (as defined in § 126b BGB).

22.3 Transferability. The user is not entitled to transfer rights and obligations under this contract to third parties without the prior written consent of Jourma. This also applies to subscriptions, which are personal and may not be transferred or assigned to third parties.

22.4 Notices. Jourma may send legally relevant notices to registered users by email or in writing. Registered users are obliged to keep their contact details up to date and to regularly check for messages from Jourma.

22.5 App Store Terms. The use of the Pro Plan is additionally subject to the Terms and Conditions of the respective App Store. In the event of a conflict between these terms and the App Store terms with respect to payment processing, billing or refunds, the App Store terms shall prevail to the extent that such matters fall within the responsibility of the App Store operator.
