Scope
The mobile application 'Jourma' (hereinafter referred to as 'App') is operated by Jourma GmbH, Taunustor 1, 60310 Frankfurt am Main (hereinafter referred to as 'Jourma'). These Terms of Use regulate the relationship between you as a user and Jourma in relation to the use of the App. They apply to all users of the App. By registering and using the App, you agree to these conditions. Each use of the App constitutes acceptance of this agreement. It is recommended to save or print a copy of these conditions for your records. Please read the agreement carefully and ensure that you agree with its content before using the App. If you do not agree, the use of the App is not permitted.
All functions and services available in the App are subject to these conditions. Deviations from these conditions require the express written consent of Jourma.
Jourma reserves the right to expand, adapt, or modify the App and the functions and services contained therein. Such changes do not entail any costs for the users in relation to the use of the App itself. Jourma will inform users about changes.
Description of Services
The App is an all-in-one travel app that combines a variety of services, including communication, information, and entertainment services, on a single platform. In addition, the App integrates third-party services to further optimize the user experience. By combining various functions in one App, the need to use several separate applications is eliminated. Users have the opportunity to leave reviews, access current content, and receive individual recommendations. A description of the individual functions is available in the App.
The offer of Jourma via the App is non-binding and without obligation.
Registration
The use of the App requires registration. Personal data must be provided, a username chosen, and a secure password set. Registration itself is free, but certain services may be subject to charges. Users have no entitlement to registration. Jourma reserves the right to reject new registrations at its own discretion.
Users must provide accurate and complete information during registration. False or incomplete information may lead to suspension or deletion of the account. Jourma is entitled to verify the accuracy of the information provided and to request evidence if necessary. Changes to personal data must be updated immediately.
After registration, the user receives a confirmation email with an activation link. The account is only activated after clicking this link in order to prevent misuse. If the confirmation is not carried out within the period specified in the email, Jourma may cancel the registration.
Only one user account is permitted per user. Multiple registrations are not allowed and may lead to suspension or deletion of all affected accounts. The transfer of the user account to third parties is also prohibited. In case of suspected unauthorized use, Jourma must be informed immediately.
The use of the App is permitted exclusively to persons who are at least 18 years old.
Usage Rights
The provision of the App takes place through downloading the App onto a suitable device. Use requires an internet-capable smartphone and a stable internet connection. The App can be installed on iOS and Android devices, and it is the responsibility of the user to ensure that their device meets the technical requirements. Jourma cannot guarantee unrestricted functionality on all devices and operating system versions. Costs incurred by the user for the technical prerequisites required for installation and use of the App must be borne by the user.
Jourma is entitled to adapt these Terms of Use at any time. Such changes may be necessary to comply with legal requirements, to introduce new functions, or to optimize existing services. Jourma will carefully consider whether an adjustment is required in the interests of the users and the company. Changes to the Terms of Use will be communicated to registered users by email with a reasonable notice period. Registered users should regularly check their emails to stay informed. If a registered user does not object to the changes within 14 days of receipt of the notification, they are considered accepted. This period does not apply to changes that are only advantageous or legally neutral for the user. The objection must be submitted in text form and may be sent by email or via a function in the App. In the event of an objection, Jourma has the right to terminate the contractual relationship, which leads to deactivation of the account. The notification period is not required if the changes are necessary to implement legal requirements or official decisions against Jourma.
Users undertake to use the App in accordance with applicable laws and these Terms of Use. Misuse, in particular bypassing security measures or spreading harmful software, is strictly prohibited. Jourma takes appropriate measures to ensure the security of the App and the integrity of user data. Violations may have legal consequences.
Provided Services and Availability
Jourma strives to ensure continuous and uninterrupted use of the App. However, uninterrupted availability cannot be guaranteed. Technical problems, maintenance, or force majeure may cause temporary restrictions. Planned maintenance will be announced in advance whenever possible. There is no claim to permanent availability of the App or individual services. Compensation claims for temporary disruptions are excluded. Users should regularly install updates to benefit from improvements and fixes. Jourma reserves the right to temporarily or permanently discontinue certain functions or services. Changes may be necessary for technical, legal, or economic reasons.
Jourma may enter into advertising partnerships with businesses, brands, companies, and partners. Such advertising may appear in the App in various forms.
The display of city boundaries when selecting a location in the App serves orientation only and is indicative. Displayed boundaries may differ from actual city limits and have no legal validity. Queries and searches within the App operate within captured city boundaries, which may vary. Displayed city areas may not fully correspond to official boundaries.
Product prices displayed in the App are given in Turkish Lira (TL) and are for orientation only. Prices may change at any time without prior notice. Jourma does not guarantee that displayed prices are current. Prices only offer users a chance to compare and make their own decisions. Product availability may vary. Images are for informational purposes only and may differ from the actual product. Jourma assumes no warranty for accuracy, timeliness, or completeness.
Displayed exchange rates and price converter data are indicative only and generally updated daily unless stated otherwise. As exchange rates fluctuate, displayed prices may vary. Jourma assumes no liability for fluctuations or deviations.
Price statistics and historical data in the App are indicative and for information only. They are not binding for business or financial decisions.
Displayed places (e.g., shops, restaurants, cafés) have no connection with Jourma. Information such as opening hours or locations may vary. Jourma assumes no warranty for such information.
Product names or descriptions (e.g., coffee specialties in a café) are standardized and may differ from actual offerings. Variations may exist.
Recommendations and blog posts are for general information only. They may contain errors and are not guaranteed to be accurate.
The App offers restaurant reservation functions. By using this service, the user agrees to receive confirmations, updates, and cancellations electronically. If a reservation cannot be kept, it must be canceled at least 30 minutes in advance via the App or phone. Restaurant terms apply. Jourma is not liable for restaurant services or charges caused by late cancellations.
User comments, ratings, and scores reflect personal opinions only. Jourma accepts no responsibility for them as long as Jourma has met its obligations.
User Responsibility for Account Security
Users are responsible for their login details and must not share them. Strong passwords are recommended and should be updated regularly. In case of suspected unauthorized access, Jourma must be notified immediately. Users can change their password via the App or request account suspension via support. Jourma will take reasonable measures to prevent misuse.
Jourma is not liable for damages caused by improper handling of login details if the user is at fault. Actions carried out through the account are attributed to the user unless unauthorized access is proven.
Intellectual Property and Copyright
All content of the App, including software, designs, trademarks, and logos, are subject to intellectual property rights of Jourma or the respective rights holders.
The use of trademarks, logos, or other protected symbols of Jourma is not permitted without express consent. This applies in particular to use in domain names, social media profiles, or online presences. Jourma will enforce rights against infringements.
Users must respect third-party copyrights. Uploading or distributing infringing content is prohibited. Jourma may remove such content and block users.
Restrictions and Prohibited Uses
The App may not be used for illegal purposes. In particular, it is prohibited to spread illegal content, commit fraud, or infringe third-party rights. Jourma reserves the right to pursue violations and take legal action.
Copying, modifying, or distributing content of the App is prohibited without consent. Circumventing technical protections or any use against these Terms of Use is forbidden. Uploading harmful software is not allowed. Jourma may remove such content and block users.
Automated systems or software (bots, scrapers, crawlers) must not be used. Jourma employs technical measures to prevent abuse. Violations may result in blocking and legal consequences.
Users undertake to use the App respectfully and responsibly. Harassment, insults, or discriminatory content are not permitted. Jourma promotes a positive community and will sanction violations.
Termination and Blocking of Accounts
Jourma reserves the right to block or terminate accounts for violations of these Terms. This applies especially to illegal activities, misuse, or violations of laws. Jourma will inform users. In serious cases, blocking may occur without prior notice.
Users may delete their account at any time via settings. Upon deletion, all rights expire. Jourma will delete or anonymize data in accordance with legal obligations.
Jourma may suspend or delete accounts due to long inactivity (12 months). Users will be informed beforehand. Users can keep the account active by logging in again.
Third-Party Services and Paid Third-Party Services
Jourma offers many services on one platform and integrates third-party services. Some services may be paid and billed directly by third parties. No contractual relationship arises with Jourma. Payments go directly to third parties.
Jourma acts only as an intermediary. All agreements, including pricing and payment, are between the user and the third party. Jourma has no control and no responsibility. Use of such offers is under the third party’s terms and privacy policies.
The App includes functions of Google Maps (Google Cloud EMEA Ltd, Dublin, Ireland). Use of Google Maps is subject to the current end-user terms and Google’s privacy policy.
Liability for Availability and Accuracy
Jourma gives no guarantee for constant availability or error-free function. Outages may occur. Jourma will try to restore quickly. Users should install updates.
Jourma and its agents exclude liability for damages, except for intent, gross negligence, injury to life/body/health, or violation of cardinal obligations. Liability for cardinal obligations is limited to typical damages. Product liability law and mandatory law remain unaffected.
Content is created carefully but Jourma gives no guarantee for accuracy, completeness, or timeliness. Users should consult other sources before making decisions. Jourma is not liable for resulting consequences.
Consequences of Violations
Jourma may suspend or terminate accounts without prior notice to protect users and security. Affected users will be informed.
Jourma will pursue violations and may initiate civil or criminal proceedings. Users causing damages must compensate. Jourma may enforce payment or take legal action if not met.
Users violating these Terms lose all rights granted through the App, especially usage rights. Jourma will revoke rights and block access. No refund claim exists.
Termination
The user agreement is indefinite. Both parties may terminate with reasonable notice. Extraordinary termination for cause remains.
Users may terminate at any time without reasons via App settings. Jourma will confirm termination and block access. Users should back up data before deletion.
Termination of the contract with Jourma does not affect third-party services. Users remain responsible for payments to third parties unless separately terminated.
Governing Law and Jurisdiction
The contract is subject to German law.
Place of performance and jurisdiction is Frankfurt am Main, as far as permitted.
If the user has no general jurisdiction in Germany, Frankfurt am Main is the non-exclusive jurisdiction.
Final Provisions
If individual provisions are invalid, the validity of the others remains. Invalid provisions are replaced with valid ones closest to their purpose. Jourma and users commit to finding amicable solutions. Jourma will keep Terms legally compliant and inform users of changes. Users have the right to accept or terminate.
Jourma may send legal notices by email or in writing. Users must keep contact data updated and check for messages.
These Terms may be translated. In case of discrepancies, the German version is legally binding.
