Scope of application
The mobile application "Jourma" (hereinafter referred to as "Jourma") is operated by Jourma GmbH, Taunustor 1, 60310 Frankfurt am Main, Germany. These terms of use govern the relationship between you as a user and Jourma GmbH with regard to the use of the app. They apply to all users of Jourma. By registering and using the app, you declare your agreement with these terms and conditions. Any use of Jourma constitutes acceptance of this agreement. It is recommended that you save or print a copy of the terms for your records. Please read the agreement carefully and ensure that you agree with its contents before using the app. If you do not agree with the terms and conditions, you are not permitted to use the app.
These terms of use define the framework conditions for the app and the associated services. They form the contractual basis between Jourma and you as the user. All functions and services available in the app are subject to these terms and conditions. Deviations from these terms and conditions require the express written consent of Jourma GmbH.
Jourma GmbH reserves the right to expand, adapt or change the app and the functions and services it contains at any time.
Definitions and definitions of terms
"App" refers to the mobile application "Jourma", which provides various digital services and functions. The app can be installed and used on smartphones, tablets and other compatible end devices. It is used on the basis of these terms and conditions and Jourma's privacy policy.
"Super app" is a mobile application that bundles a variety of services and functions within a single platform. It combines different applications and services so that users do not need several separate apps.
"User" means any natural person who uses Jourma, regardless of whether registration has taken place. The app may be used for both private and business purposes, provided that this is in accordance with these terms of use. Every user is obliged to comply with applicable law. Use of the app is subject to acceptance of these terms and conditions.
"Services" include all functions and services provided by Jourma or third-party providers via the app. These include communication and information services as well as various digital offers. Jourma strives for high service quality and availability. The type and scope of the services may change and are described within the app.
"Content" includes all texts, images, videos and other materials accessible via Jourma. These can be provided by Jourma itself or by third-party providers. Users are obliged to use content only within the scope of the rights of use granted to them and may not reproduce or pass it on without permission. Jourma accepts no liability for the accuracy, completeness or currency of the content provided.
"Contractual partners" are both Jourma GmbH and the respective user. By using the app, a contractual relationship is established between the parties, which is subject to these terms of use. Both parties are obliged to fulfil their rights and obligations under the agreement. Violations of the terms and conditions may result in legal consequences, which are regulated in these terms of use.
"Third-party providers" are external companies that offer content or services via Jourma. Jourma cooperates with various third-party providers to expand the range of services offered by the app. These third-party providers operate independently and are not part of Jourma GmbH. Jourma accepts no responsibility for content or services provided by third-party providers.
Rights of use
Use of the Jourma app is only permitted to persons who have reached the age of 16. A user account must be created before using the app for the first time. Jourma reserves the right to refuse new registrations at its own discretion. Use requires an internet-enabled smartphone and a stable internet connection. The app can be installed on iOS and Android devices, whereby it is the user's responsibility to ensure that their device fulfils the technical requirements. Jourma cannot guarantee unrestricted functionality on all end devices and operating system versions.
Jourma is authorized to amend these terms of use at any time. Such changes may be necessary to comply with legal requirements, to introduce new functions or to optimize existing services. In doing so, Jourma will carefully consider whether an adjustment is necessary in the interests of the users and the company. Changes to the terms of use will be communicated to users in good time in the app or by e-mail. Jourma will inform users at least 30 days before the changes come into effect and provide a summary of the main changes. Users should regularly check their emails and app notifications to stay informed about changes. If a user does not object to the changes within 30 days, they are deemed to have been accepted. The objection must be made in text form and can be sent by email or via a special function in the app. In the event of an objection, Jourma has the right to terminate the contractual relationship with the user, which will result in the deactivation of the user account.
Users undertake to use the app in accordance with applicable laws and these Terms of Use. Improper use, in particular the circumvention of security measures or the distribution of malicious software, is strictly prohibited. Jourma takes appropriate measures to ensure the security of the app and the integrity of user data. Violations may result in legal consequences.
Services provided and availability
Jourma is an app that combines a variety of services, including communication, information and entertainment services, on a single platform. Jourma also integrates third-party services to further optimize the user experience. By combining different functions in one app, there is no need to use several separate applications. Users can leave reviews, access the latest content and receive personalized recommendations. A detailed description of the individual functions is available in the app. Each function offered is explained in detail so that users understand exactly which services are available.
Jourma endeavors to ensure continuous and uninterrupted use of the app. However, uninterrupted availability cannot be guaranteed. Technical problems, maintenance work or force majeure may cause temporary restrictions. Planned maintenance work will be announced in advance where possible. There is no entitlement to constant availability of the app or individual services. Compensation claims for temporary disruptions are excluded. Users should regularly install updates in order to benefit from improvements and bug fixes. Jourma reserves the right to discontinue certain services temporarily or permanently. Changes may be necessary for technical, legal or economic reasons. Users will be informed of such measures in good time and may be offered alternative solutions.
Jourma can enter into advertising partnerships with shops, brands, companies and partners. This advertising can be placed in the app in various forms.Jourma is authorized to address its users via various channels and platforms with marketing measures and information.
The city boundaries shown when selecting a location within the app are for orientation purposes only and are indicative. The displayed boundaries may differ from the actual city boundaries and are not legally binding. Within the app, queries and searches are carried out within the recorded city limits of a city, but the delimitation of the city limits may vary. The city areas shown may therefore not fully correspond to the official administrative boundaries in some cases.
The product prices shown in the app are in Turkish Lira (TL) and are for guidance only. Prices are subject to change at any time without prior notice. Similarly, stock levels and availability of products are subject to fluctuation and products may be temporarily or permanently unavailable. Product images are for information purposes only and may differ from the actual product offered. Jourma does not guarantee the accuracy, timeliness or completeness of this information and cannot be held liable for any resulting discrepancies or changes.
The exchange rates displayed on the main screen and the data used in the price converter are for guidance only and are updated daily. As exchange rates may change during the day, the product prices displayed in the app may also vary. Jourma accepts no liability for fluctuations in exchange rates or possible deviations in the exchange rates displayed
Price statistics and historical data displayed in the app are to be understood as guidelines. They are for information purposes only and cannot be used as a binding basis for business or financial decisions.
Independence of the places displayed: The places shown in the app (e.g. shops, restaurants, cafés) are not connected to Jourma. Information such as opening status, operating hours or location details may vary and are subject to change. Jourma accepts no liability for this.
The product names and/or descriptions displayed in the app have been standardized and may differ from the products actually offered in the respective facilities. For example, a product may be offered in different variations.
The "recommendations" and "blog posts" provided in the app are for general information purposes only. They may contain incompleteness or errors and are not to be understood as binding or guaranteed accurate information.

The user comments, ratings and scores published in the app exclusively reflect the opinion of the respective user. Jourma accepts no responsibility or liability for this.
Registration
The use of Jourma requires registration. This involves entering personal data, choosing a user name and setting a secure password. Registration itself is free of charge, but certain services may be subject to a charge.Users must provide correct and complete information when registering. Incorrect or incomplete information may result in the account being blocked or cancelled. Jourma is authorized to check the accuracy of the data provided and, if necessary, to request proof. Changes to personal data must be updated immediately.
After registration, the user receives a confirmation e-mail with an activation link. The account will only be activated after clicking on this link in order to prevent misuse. If the confirmation is not carried out within the period specified in the e-mail, Jourma may cancel the registration. Only one user account is permitted per user. Multiple registrations are not permitted and may lead to the blocking or cancellation of all accounts concerned. Passing on the user account to third parties is also prohibited. If unauthorized use is suspected, Jourma must be informed immediately.
Responsibility of the user for account security
Users themselves are responsible for the security of their access data and must not pass it on to third parties. It is recommended to choose a secure password and to update it regularly. If unauthorized access is suspected, Jourma must be notified immediately. Users can change their password via the app or contact support to block the account. Jourma will take all reasonable measures to prevent misuse.
Jourma is not liable for damages caused by improper handling of the access data if the user is responsible for this. Any action carried out via the account shall be attributed to the user, unless unauthorized access is proven.
Intellectual property rights and copyrights
All contents of the app, including software, designs, brands and logos, are subject to the intellectual property rights of Jourma or their respective rights holders. By using the app, the user does not acquire any rights to this content. Any duplication, distribution, public reproduction or editing of the content without authorization is prohibited and may result in legal consequences.
The use of trademarks, logos or other protected signs of Jourma is not permitted without express consent. This applies in particular to the use in domain names, social media profiles or other online presences. Jourma will consistently pursue violations of intellectual property rights.
Users are obliged to respect the copyrights of third parties. No content may be uploaded or distributed that violates these rights. Jourma reserves the right to remove such content and to block affected users.
Restrictions and prohibited uses
The Jourma app may not be used for illegal purposes. In particular, it is prohibited to use the app to distribute illegal content, for fraudulent activities or to violate the rights of third parties. Jourma reserves the right to consistently pursue offences and to take the necessary legal action.
Copying, modifying or distributing the content of the app is not permitted without express consent. This also applies to the circumvention of technical protection measures or any use of the app that violates these terms of use. It is prohibited to upload or distribute content that contains malware, viruses or other harmful components. Jourma reserves the right to remove such content immediately and to block the user concerned.
The use of automated systems or software to interact with the app, in particular bots, scrapers or crawlers, is prohibited. Jourma uses technical measures to prevent such misuse. Violations can lead to the account being blocked and to legal consequences.
Users undertake to use the app respectfully and responsibly. Harassment, insults or discriminatory content are not permitted. Jourma promotes a positive and respectful community and will punish offences accordingly.
Cancellation and blocking of the user account
Jourma reserves the right to block or terminate accounts in the event of violations of the terms of use. This applies in particular to illegal activities, misuse of the app or violations of applicable laws. Jourma will inform the user of the blocking or cancellation. In serious cases, the user may be blocked without prior notice.
The user can delete their account at any time. The account can be deleted via the account settings in the app. With the deletion, all rights of the user to the services and content of the app expire. Jourma will delete or anonymize all personal data of the user in accordance with the legal requirements.
Jourma may also block or delete user accounts in the event of prolonged inactivity. Inactivity exists if a user has not used the app's services for a period of 12 months. Jourma will inform the user in good time before deleting the account. The user has the option of keeping their account active by logging in again.
Third-party services subject to a charge
Jourma offers a variety of services on a single platform. Jourma also enables the integration of third-party services to enhance the user experience. Certain services available via the platform may be subject to a charge. In such cases, billing takes place directly via the respective third-party provider, without the involvement of Jourma. If users make use of such chargeable offers, they leave the Jourma platform and go to the platform of a third party who acts independently and is not directly connected to Jourma. Payments are to be made directly to the third party.
When using third-party services, no contractual relationship is established between the user and Jourma. Jourma merely acts as an intermediary and provides the technical platform through which the user can access third-party services. All contractual agreements, including pricing, payment processing and service provision, are made exclusively between the user and the respective third-party provider. Jourma has no control over these services and accepts no responsibility for their content, quality or availability. By using such services, the user is forwarded directly to the third-party provider and is subject to their terms and conditions and data protection guidelines.
Liability for the availability and accuracy of the services
Jourma assumes no liability for the constant availability and error-free functioning of the services offered. Temporary outages or restrictions may occur, in particular due to technical faults, maintenance work or external circumstances beyond Jourma's control. However, Jourma endeavors to rectify such interruptions as quickly as possible and restore regular operation. To ensure the best possible use of the app, it is recommended that you install regular updates.
Jourma is not liable for damages arising from the use or non-use of the services, unless these are due to intentional or grossly negligent behavior on the part of Jourma. This includes direct and indirect damages as well as consequential damages or lost profits. Jourma takes reasonable precautions to minimize risks and ensure safe use of the services. However, the use of the app is at the user's own risk.
The content provided in Jourma is created and maintained with the greatest possible care, but Jourma does not guarantee that it is correct, complete or up-to-date. It is possible that content may be incorrect or incomplete. Users should therefore always consult additional sources and conduct their own research before making decisions based on the information provided. Jourma is not liable for any resulting consequences.
Jourma is not responsible for technical problems caused by the user's end devices or internet connection. The user is responsible for ensuring that their device fulfils the technical requirements of the app and that there is a stable internet connection. In the event of technical difficulties, the user should first check their own systems and networks. Jourma offers troubleshooting support, but cannot guarantee the complete resolution of technical problems.
Exclusions of liability for certain damages and risks
Jourma assumes no liability for indirect damages, lost profits or immaterial impairments. This applies in particular to damage caused by data loss, business interruptions or other technical faults. However, Jourma will take all reasonable measures to reduce such risks or minimize their effects. Users are required to make regular back-up copies of their data and to take appropriate security precautions.
Jourma is not liable for damages caused by force majeure or unforeseeable events. These include, in particular, natural disasters, wars, strikes or official orders that are beyond Jourma's control. However, the company will endeavor to minimize the impact of such events and restore services as quickly as possible. Users should be aware of possible risks and take appropriate precautions where necessary.
Jourma accepts no liability for damage caused by the use of third-party services or content. Users should be aware that third-party providers have their own terms and conditions and privacy policies over which Jourma has no control. Despite careful selection of third-party providers, Jourma cannot accept any responsibility for their actions or omissions. Users are therefore encouraged to carefully check the respective terms of use of the third-party providers and to use their offers with appropriate care.
Jourma is not liable for damages caused by improper use of the app or violations of the terms of use. Users are obliged to use the app and its content exclusively within the framework of the applicable provisions. Misuse or violations of these terms and conditions may result in damages for which the user is solely responsible. Jourma reserves the right to take legal action in such cases and, if necessary, to impose sanctions on the user.
Limitation of liability
Jourma is only liable for intent and gross negligence as well as for the breach of essential contractual obligations (cardinal obligations). In the event of slight negligence, Jourma shall only be liable for typical and foreseeable damage. Liability for unforeseeable or atypical damages is excluded.
Jourma's liability for personal injury (injury to life, limb or health) remains unaffected by the aforementioned limitations of liability. In such cases, Jourma will fully comply with the statutory provisions. Users have the right to assert claims for damages if the legal requirements are met. Jourma will examine such claims carefully and process them appropriately.
Jourma is not liable for damages caused by improper use of the app or by violations of the terms of use. The user is solely responsible for compliance with these terms and conditions and the proper use of the app. Violations may lead to the blocking or cancellation of the account. Jourma reserves the right to take legal action in the event of violations.
Liability of the user for the use of the app
The user is liable for all damage caused by him/her. This includes damages caused by improper use of the app, violations of the terms of use or the violation of third party rights. The user is obliged to indemnify Jourma from all claims of third parties that are asserted due to his behavior. In such cases, Jourma will inform the user of the claims and give the user the opportunity to respond.
The user is obliged to take all necessary measures to prevent or minimize damage. This includes, among other things, the secure storage of access data and the regular updating of the app. In the event of suspected misuse or security vulnerabilities, the user should inform Jourma immediately. In such cases, Jourma will take appropriate measures to ensure the security of the app and user data.
The user is liable for all activities that take place via his account, unless he can prove that his account was misused without his knowledge and consent. The user is obliged to keep his password and other access data secret and to protect them from access by third parties. If misuse is suspected, the user should change his password immediately and inform Jourma. In such cases, Jourma will temporarily block the user's account to prevent further misuse.
The user is liable for the accuracy and completeness of the information provided. Incorrect or incomplete information can lead to damages for which the user is solely responsible. Jourma reserves the right to check the user if false information is suspected and to take action if necessary. The user should ensure that all information in their account is up-to-date and correct.
Exclusion of liability for content and services of third-party providers
Jourma accepts no liability for the content and services of third-party providers. These contents and services are subject to the respective terms and conditions of the third-party providers. Jourma checks the third-party providers carefully, but cannot accept any liability for their services. Users should read the terms and conditions of the third-party providers carefully and use their services with caution.
Jourma is not liable for damages caused by the use of third-party services. This includes, but is not limited to, technical malfunctions, data loss or other problems caused by third-party providers. Users should inform themselves about the possible risks of using third-party services and take appropriate precautions. Jourma offers support in solving problems with third-party services, but accepts no liability.
Jourma assumes no liability for the quality or suitability of the content and services of third-party providers. Users should carefully check whether these contents and services meet their requirements. Jourma will regularly check the quality and reliability of third-party providers, but cannot guarantee their services. Complaints about third-party providers should be addressed directly to the respective provider.
Prohibited activities and content
The use of the app for illegal activities, harassment of other users or the distribution of harmful software is expressly prohibited. Jourma does not tolerate any violations of applicable law or common decency. Users who violate these provisions must expect legal consequences. Jourma will take all necessary measures to ensure the security and integrity of the app.
Users may not upload or disseminate any defamatory, offensive, racist, sexist or otherwise discriminatory content. Such content is a violation of the terms of use and can lead to the account being blocked. Jourma will remove unauthorized content immediately and inform the user concerned. Users are aware that they are fully responsible for the content they upload.
The distribution of spam, phishing attempts or fraudulent content via the app is prohibited. The app may not be used to distribute unwanted or misleading messages. Jourma will consistently pursue violations, block the accounts concerned and take further measures if necessary. Users should report suspicious activity immediately to ensure the safety of the community.
It is strictly forbidden to take technical measures that impair the functionality of the app or jeopardize security. This includes hacking, phishing and the use of malware. Jourma will take both technical and legal steps to prevent such offences. Users must be aware that offences may result in criminal prosecution.
Consequences of violations of the terms of use
Jourma reserves the right to block or terminate accounts without prior notice in the event of violations of the Terms of Use. This serves to protect users and to maintain the security and integrity of the app. Jourma will inform the user concerned of the measures taken and the reasons.
Jourma consistently pursues violations of the terms of use and reserves the right to initiate civil and criminal proceedings. Users who violate the provisions must expect legal consequences. Jourma will collect the necessary evidence and inform the relevant authorities. Users who cause damage through their behavior are obliged to compensate for this. Jourma will quantify the damage caused and demand payment. If the user does not fulfil their obligation, Jourma reserves the right to take legal action.
Users who violate the Terms of Use shall lose all rights granted by the app. This includes in particular the right to use content and services. Jourma will immediately revoke the rights in question and block access to the app. There is no entitlement to a refund of fees already paid.
Cancellation
Both the user and Jourma can terminate the contractual relationship at any time subject to a reasonable notice period. The cancellation can be made either in writing or via the corresponding functions within the app. Jourma will inform the user of the cancellation and its consequences. Upon termination, all rights and obligations arising from the contractual relationship shall expire.
Jourma reserves the right to terminate the contractual relationship without notice if there is good cause. Such a reason exists in particular if the user violates essential provisions of the terms of use. In this case, Jourma will inform the user of the termination without notice and the underlying reasons. The user has the right to object to the cancellation.
Users can cancel the contractual relationship at any time without giving reasons. The cancellation can be made via the account settings in the app. After cancellation, Jourma will notify the user of the termination of the contractual relationship and block access to the app. Users should back up all relevant data before cancelling, as there is no longer any access to stored content or personal data after the account has been deactivated.
Jourma provides users with assistance in the cancellation process. This includes, among other things, information on the cancellation process and the deletion of personal data. Users can contact customer service at any time with questions or problems. Jourma undertakes to process all enquiries as quickly as possible and to ensure that the cancellation process runs smoothly.
Consequences of cancellation for both parties
After cancellation, the user no longer has access to his account and the associated data. Jourma will block the user's account and delete all personal data in accordance with legal requirements. Users should ensure that they have backed up all important data before cancellation. Jourma accepts no liability for loss of data after cancellation.
The termination of the contractual relationship between the user and Jourma has no effect on existing contractual relationships with third-party providers whose services were used via the app. If the user has used paid or free third-party services, these will continue to exist regardless of the cancellation of the Jourma account.
The use of third-party services is subject to the respective terms and conditions and agreements of the third-party provider, which Jourma does not influence. Cancellation with Jourma does not automatically lead to the termination of such contracts, and the user is responsible for cancelling them directly with the third-party provider if necessary.
Payment obligations to third-party providers: If the user has agreed payments for certain third-party services, these shall continue regardless of the cancellation of the Jourma account. The user remains obliged to pay amounts due to the third-party provider directly, unless the contractual relationship with the third-party provider has been terminated separately.
Jourma recommends that users check their existing contracts with third-party providers before cancelling their Jourma account to ensure that no unwanted costs or obligations remain. Users should contact the relevant third-party provider directly if they no longer wish to use their services.
Applicable law and place of jurisdiction
The contract is subject to German law. The place of fulfilment is Frankfurt am Main.
The place of jurisdiction for all legal disputes arising from or in connection with this contract shall be Frankfurt am Main.
Final provisions
Should individual provisions of these Terms of Use be invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision. Users and Jourma undertake to find an amicable solution in such cases. Jourma will take all necessary measures to ensure that the terms of use comply with the statutory provisions. In the event that a provision is invalid, the parties undertake to agree on a provision that comes as close as possible to the economic purpose of the invalid provision. Jourma will take all necessary steps to adapt the terms of use accordingly. Users will be informed of such changes in good time and have the right to accept the new conditions or to terminate the contractual relationship.
Jourma may send legally relevant messages to users via the app, email or in writing. Users are obliged to keep their contact details up to date and to regularly check for messages from Jourma.
These Terms of Use may be translated into several languages. In the event of discrepancies or ambiguities between different language versions, only the German version shall prevail and be legally binding.
Amendments, supplements or deviations from these Terms of Use must be made in writing. This also applies to changes to the written form requirement.
Jourma reserves the right to change or amend the terms of use at any time. The user will be notified of any changes or additions in good time. Users have the right to object to the changes or to terminate the contractual relationship. Jourma will carefully review all changes and ensure that they are in the best interests of users and the company.
